摘要
我国正处于快速城市化和工业化发展阶段,农村集体土地被大量征用是一个必然趋势。现行土地征用制度在调整国家、集体、用地单位、农民四者之间的利益矛盾上发挥了积极作用,但是这种制度在具体实践中存在缺陷。本文在分析我国现行土地征用制度存在的缺陷同时,探索一条适合国情的针对现行土地征用制度的改革途径。
Now our country is being in the development phase of fast industrialization and urbanization, and peasant＇s land being massively requisitioned is a inevitable trend. The current land requisition system plays an positive part in adjusting the benefits and conflict among nation.collective, the department who uses land and peasant. But there are various drawbacks in the current land requisition system,which are unfavorable for the protection of peasant＇s legal rights. Based on an analysis about the drawbacks in the current land requisition system, this paper ties to point out the measures for the reformation and perfection of china current land requisition system.
