摘要
重视精神赡养是我国社会发展的必然要求。精神赡养的界定应当合乎我国社会发展的现实和趋势,不应局限于婚姻家庭关系领域,这是完善精神赡养立法的逻辑起点。精神赡养制度应当考虑精神赡养作为权利和义务两重意义的操作要求,并注意与现行法律规定相衔接,以有利于在实践中提高精神赡养法律适用的实效,促进社会的和谐发展。
It is inevitable to emphasize the spiritual support in the developing process of the society. It must conform to the actual situation and the trend of the social development, and it can not be limited in the matrimonial relationship, which is the starting point of the legal system of the spiritual support. Therefore, in order to improve the system, two components must be got into consideration, namely the right and the duty, so that it can be in accordance with the current laws, raise the legal effect,and promote the society into harmony.
