摘要
抽象行政行为越权是行政主体行政规则过程中的越权,是以行政机关为单一形态的越权,是以超越行政权为主要特征的越权。抽象行政行为越权表现为超越事态管辖权,超越程序性的权力,超越上位规则设定事项的权力,超越行政禁止设定权。对于抽象行政行为越权者应追究其法律责任。
The excess of power of abstract administrative act is one kind of excess of power that oversteps the administrative power, jurisdiction, procedural power, right of administrative prohibiting institution and takes place in the course of administrative subject＇ s administration. The excess of power of abstract administrative act should be investigated and the legal responsibility should be fixed.
