摘要
学校事故中学校与学生的关系是规范学校事故民事责任的法理基础。学校与学生的关系既不是一种监护关系,也不是一种准行政关系,更不是一种可以大而化之的合同关系,而是一种教育、管理、保护关系。这种关系不应因学校性质的不同而区别对待,且不排除学校和学生或其监护人的合法约定。
The relationship between the school and the student in the school accident is the legal basis of regulating the civil liability in the school accident. The relationship between the school and the students is neither that of guardianship nor quasi-administration, nor the broad contract relationship, but a relationship among education, management and protection. This kind of relationship should not be differently treated according to different school ownership and not exclude the legal contract between the school and the student or the guardian.
