依法治教视阈下高校自治探析 被引量:2

An analysis of implementing university′s autonomy from the perspective of managing education by law

摘要 高校自治与依法治教,本质上是一致的,核心内容都是以人为本,保障师生的学术自由、教学自由和学习自由的权利。依法治教视阈下高校自治的基本途径:(1)进一步完善教育法律体系;(2)完善内部自治制度,明确自治章程的效力;(3)构建行业自律组织、社会化评估机构,健全争议仲裁制度;(4)建立高校公共财政和经费基金会,完善教育投入机制;(5)完善程序,建立仲裁前置、法院终审的争议解决机制。 Actually they are identical in essence that the main content of university's autonomy and managing education by law is people-first, to guarantee the academic freedom, teaching and learning freedom. Here are some main approaches of implementing university's autonomy. First, further improve the educational legal system. Second, improve the internal autonomy system and define the effect of autonomy rules. Third, construct the independent management of the trades and the socialized appraisal agency, perfect the system to arbitrate disputes. Forth, set up university's public finance and funds foundation and improve the mechanism of the input in education. Fifth, improve the procedure and set up the mechanism of leading arbitration and the mechanism of solution to disputes in Court's last instance.
