摘要
在互联网空间中,传统国际私法的基本原则将因互联网的全球性、虚拟性、开放性和管理非中心化而受到不同程度的冲击与影响。其中,国家主权原则的影响力将被削弱;国际合作与协调将是互联网环境下国际私法发展的必经之路,国际协调与合作原则将在网络空间发挥重要作用;保护弱者合法权益原则在互联网环境下其地位必将得到提升而成为互联网冲突法立法的重心。
In the context of Internet, fundamental principles of traditional private international law is under impact and sway of the Internet＇ s universality, virtuality, openness, and its decentralization of management. Among them, principle of sovereignty will have a weakened influence ; principle of international cooperation and reconciliation, which is to be the destined way for the development of private international law in the Internet context, will play an important role in cyber space ; principle of protecting the disadvantaged will be elevated and accordingly become the focal point of legislating in respect of rules of conflict concerning Internet.
