摘要
房屋联建合同纠纷在现实生活中时常发生,而司法实践在处理这类纠纷时常常无所适从。从房屋联建合同的义务和内容入手,正确分析房屋联建合同的性质是处理这类纠纷的前提。以此为基础,分析、评价可能影响房屋联建合同效力的相关因素是处理这类纠纷的关键。同时,将名为房屋联建合同的合同与真正的房屋联建合同进行区分可以真正清晰、正确地认识影响房屋联建合同效力的因素,从而正确处理房屋联建合同纠纷。
With reference to the contents and the obligations covered in the joint-construction housing contract, the paper proposes that a sound analysis of the nature of the joint-construction housing contract serves as the premise to settle disputes over cases of the kind. It then continues to argue that it is vitally important to conduct an analysis and assessment of the related factors which may affect the effectiveness of such contracts. Meanwhile, it is necessary to distinguish between a nominal contract and a real contract, and to achieve a better understanding of the factors which affect the effectiveness of the contract.
