摘要
大赦是由国家发布政令,对罪刑进行免除的一项制度。汉代以后,赦书中常伴有对臣民的赏赐和复除蠲免等内容,属于皇帝“推恩”性质。但在唐代,大赦的性质发生较大变化,赦书中开始大量出现与朝廷行政有关的申明和禁令,远远超出“推恩”范畴。唐代赦书内容的扩展,是唐代“王言”系统中出现的一种“差遣”做法,是为应对现实政治问题而采取的“权宜之法”,具有制度变迁和政治控制两方面的意义。
The general pardon is a system by which the state issues decrees to exempt prisoners from their punishment.In the Han dynasty and later,a decree of pardon often contained orders for re- wards from the emperor to officials and the common people,as well as reductions in and exemp tion from taxes and levies.That was a way of showing the emperor's mercy to his subjects. However,major changes in the nature of the general pardon took place in the Tang Dynasty.A number of declarations and prohibitions connected with the imperial administration began to ap- pear in decrees of pardon.As a result,the function of the general pardon went far beyond show- ing the emperor's mercy.The changes point to the tendency of“duty assignment”in the Tang Dynasty system of the emperor's words.As a makeshift measure in response to practical political problems,it had implications both for institutional transition and political control.
