摘要
产权残缺是中国农村土地产权制度的基本问题。主要体现为产权主体的模糊性、虚置性,以及多级性的集体所有权主体又都不具备法律上的人格。从积极产权和消极产权来看,农民土地产权的残缺众多方面及其所引发的利益争夺和社会冲突,已成为当前一个十分令人关注的社会问题。
Being a fundamental issue of land property fights in Chinese rural areas, the fragmentary property fights are characterized by the vagueness and unfound settlement of the subject of property rights. Furthermore, the subject of the collective ownership at multiple levels fails to possess legal character. Considering the active and negative property rights, the benefit struggles and social conflicts resulted from the fragmentary land property rights of the peasants has currently become a hot social issue.
