摘要
法律是正式制度的重要组成部分,有效率的法律能提供有效的激励机制。法律激励是通过赋予权利(权力)、明确责任、强制约束等法律规范的设置来实现的。其功能的发挥需要建立利益表达、利益博弈、利益综合与利益实现的合理机制。其实现的充分条件是建立立法的公众参与制度,而健全的法律实施机制则是法律激励功能实现的必要条件。
Law is an important part of formal system, and efficient law can provide effective incentive mechanism. Law incentives can be realized by setting the legal specifications of endowing rights, defining responsibilities and forcing restriction. Its functioning relies on the establishment of a reasonable mechanism for interest expression, interest game, interest integration and interest realization. A system of public participation in legislation is the satisfying condition, and sound law enforcement mechanism is the necessity to realize the function of law incentive.
