摘要
先秦法家在春秋战国的变革时代对法律起源思想作了许多有益的探讨,他们从历史进化论和人性论的角度分析和研究法律起源的理论前提,并从“利”的层面出发阐发了法律起源思想。历史地分析和评价其思想有助于对“以法治国”理论的理解。
The Legalism of the Pre-Qin period did a lot of discussions on the origin thought of law in the Spring and Autumn periods and the Warring states, they analyzed and studied the theory of the legal origin in terms of history evolution and the theory of human nature. An historical Analysis of the theories contributes to the understanding of the theory of governing a country by law.
