摘要
对于网络域名与商标权冲突这一法律问题,目前学者争议颇多。大多数学者都赞成驰名商标在域名领域的特殊保护和普通商标的相对有限保护,而且从不同的角度进行了探讨。但是对于给予这两类商标区别保护的深层原因研究较少,本文将对这一问题进行审视,力求进一步阐释商标权在网络城名领域的保护机制和法律依据。
Conflicts between domain names and trademarks is a disputed law issue at present. Most researchers approve of the opinion that the well - known trademarks should be specially protected, however the ordinary trademarks only are limitedly protected, and they also did some research on it from various angles. However the profoundreasons of the distinct protect on trademarks was rarely mentioned. The essay studies the issue all - sidedly so as toset forth the protect system and law foundation of trademarks in domain field.
