摘要
信用证欺诈例外原则,是各国在国际贸易实践中逐渐建立完善的一种遏制信用证欺诈的重要制度。但不能将其作用绝对化,对它的使用不能过滥,否则会动摇信用证制度的根本。因此,实践中应严格限制信用证欺诈例外原则适用的条件,并应严格依照法定程序使用之。
The fraud exception principle is an important practice gradually established in the practice of international trade to deter frauds in the use of letters of credit. But the use of the principle cannot be absolute and excessive or the foundation of the system of letters of credit would be shaken. Therefore, in practice, the conditions for applying fraud exception should be strictly restricted and the principle should be applied in strict accordance with legal procedures.
