摘要
在现代民主共和制下,议会被认为是民主体制的基石;从一定意义上讲,一国议会制度的成熟程度,是其民主体制发展程度的核心标志。在宪政民主体制下,对议会的职权范围和行使方式的设定,一般都在国家的宪法之中有明确的原则表述。但是,各国议会的职权范围、组织结构和具体行使方式,则往往因该国的宪政体制、文化传统和历史发展阶段的差异而有所不同。尤其是在地方一级,甚至在同一个国家之内也难以找到完全相同的两个地方议会。尽管如此,现代议会民主制的运作却存在着一些共同的要素,这些要素反映了人类政治文明发展的共同成果。因此,我们可以通过对国外一些国家地方议会职权行使状况的比较分析,总结和发掘出一些可借鉴的规则、方法和原理,以期对我国的人民代表大会制度建设、特别是地方人大建设,有所启迪。
In the modern democratic and republic system, parliament is considered as the cornerstone of thedemocratic system. In a certain sense, the maturity of a country’s parliament system is an indicator of the progress in thedevelopment of its democratic system. Under the constitutional democracy, the definition of the parliament’s authority isoften clearly stated in the constitution of the country. However, in different countries, the authority scope, theorganization and the specific performance vary with the constitutional system, cultural tradition and the historicaldeveloping stage. On the local level, the differences are so large that even in the same country we cannot find twocompletely same local parliaments. Nevertheless, in the performance of modern parliamentary democracy there are somecommon factors, which are the shared achievements in the development of human political civilization. As a result,through comparative analysis of the performances of some foreign local parliaments, we can summarize and find somerules, methods and principles, which, we hope, will shed some light on the construction of the people’s congress systemin China and particularly local people’s congress.
