摘要
WTO框架内的保障措施是WTO授权各成员方在一定条件下用以保护和调整本国境内产业,避免大量进口冲击的安全阀之一。根据乌拉圭回合达成的《保障措施协定》和外国实施保障措施的现状,中国应尽快建立预警机制,积极介入调查过程,充分利用磋商机会,利用保障措施条款和WTO争端解决机制切实维护自身权益。
Safeguard Measures of WTO are one of the safety valves that wro authorizes every member to protect and regulate the industries of its country under certain circumstances and prevents a large number of import＇s impact. According to ＂Safeguard Measures Agreement＂ that is reached on Uruguay Round and the status quo of the safeguard measures in foreign countries, China should set up systems in advance as early as possible, positively be involved in the investigation, seek opportunity to negotiate, make full use of the terms of the safeguard measures and mechanism to settle disputes in order to assert its own benefits.
