摘要
在现代证据制度中,非法证据排除规则是保证证据有效性的重要规则,而非法证据排除规则的理论基础又是确立非法证据排除规则的前提和基础。我国要建立符合国情的科学合理的非法证据排除规则,就必须首先确立我国非法证据排除规则的理论基础。从目前国外情况看,存在三种非法证据排除规则理论,即虚伪排除理论、人权保障理论和违法控制理论。根据我国的国情和司法状况,我国应当将基本人权保障理论和重大违法控制理论作为我国非法证据排除规则的理论基础。
In modem system of evidence, the theoretical base is a prerequisite to the exclusionary rule of unlawfully obtained evidence. To constitute a scientific and rational exclusionary rule of unlawfully obtained evidence in our country, we must establish the theoretical base. There are three kinds of exclusionary rule of unlawfully obtained evidence in foreign countries, such as falseness exclusion, human rights protection and unlawful action control. According to our national con- dition and judicial practice, we should establish the theoretical base of basic human rights protection and serious unlawfully action control for our exclusionary rule of unlawfully obtained evidence.
