摘要
社会基本权承载着保障立宪主义下的市民宪法秩序的职责,在本质上是与自由要有同等功能的法规范。社会基本权的构成内容与范围几乎涉及到社会生活中的各个层面。社会基本权的目的在于要求国家积极担负起照顾人民的基本生活需要,解决社会问题的职责来。但是,在社会基本权的具体实现时却不可避免地遭遇理论上和实践上的障碍和困难。关于社会基本权规范效力的理论在各国宪法学界存在着广泛的争论。
As a modem right, the conception of fundamental social right goes against the people＇ s understanding of conception of traditional fundamental right and definition of the state＇s role. Therefore, the common theories claim that fundamental social right is not a universal right. These theories apparently cannot offer a satisfactory solution to some essential problems of fundamental social rights. This article attempts to establish the basic structure of fundamental social right and makes it starting point of and reference for discussing all constitutional issues especially fundamental social right from macro-view to micro-view. First, this article analyzes the difference between fundamental social rights and traditional fundamental rights in order to understand the nature, the content and the tenet of fundamental social right. Second, it discusses some dilemmas of fundamental social right in theory and practice and draws some conclusions regarding possibility of judicial relief for them.
