摘要
物权法基本原则作为物权法制定、解释、适用、研究的最基本规则,在物权立法中占据着重要地位,我国理论界对此问题提出过多种学说,而当前出台的物权法草案也表现出明确的立法倾向。基于物权法特有的法律属性,并结合我国的具体国情,我国物权法应以物权法定、一物一权、公示公信和物权变动与其原因行为的区分原则作为其基本原则。
The real right law ＇s basic principles, as an important proposition, have a great influence upon the legislation, interpretation and application of real right law. There are all kinds of doctrines about this issue, including the new bill of real right law enacted by the National People＇s Congress. Concerning about the characteristic of real right law, as well as our country＇s actual conditions, we should establish four principles in our real right law： rights confirmed only by laws, one proprietary rights on one independent goods entity,sign and binding,discrimination principle.
