摘要
随着经济发展速度加快,城市拆迁改造的范围不断扩大。房屋拆迁过程中因利益冲突引发的各种矛盾和冲突,使得以法律的方式保护当事人的私权问题逐渐浮出水面。然而,面对实践中的新情况,现行法律的粗糙和缺位对私权保护非常不利。本文主要围绕上述核心议题展开深入的社会调查, 指出立法领域的不足和权利保护的不周。
As the high-speed of the economic development, the area of removing and rebuilding in the city is enlarged continually. During the removing of the houses, all kinds of contradictions and conflicts caused by the benefit make it come out gradually to protect the party＇s private rights by the law. However, facing the new condition, it is not beneficial to protect the private rights for the roughness and shortage of the present law. The article evolves social investigation about those problems and points out the shortage of the legislation and the deficiency of rights-protecting.
