摘要
本文在明确聚众淫乱行为的含义后,从聚众淫乱罪立法化是立法者无视行为人权利的表现以及聚众淫乱行为是有受害者、与卖淫行为相似的违法行为两个方面论述了将聚众淫乱行为定罪而处罚聚众淫乱上游行为的理由。
The article nails down the meanings of the assembled pruriency. It discusses the reasons to convict and punish the assembled pruriency from the two aspects, one is that the legislation of the assembled pruriency is the behavior of legislator＇s disregarding the conductor＇s right, the other is that the assembled pruriency is irregular behavior with casualty and similar to the harlotry.
