摘要
波斯纳在建立其经济分析法学的理论体系时,并没有局限于狭隘的经济理性层面,而是致力于将法律从功利主义向实用主义进行最佳的融合,最大限度发挥法律的社会功能,重视对经济分析法学的哲学基础的阐述。特别值得重视的是,波斯纳从实用主义的角度探讨了公平与效率的关系,从而具体分析了其经济分析法学理论的功利主义哲学基础。
When establishing his theoretic system of Economic Analysis of Law, Posner was not confined in the narrow economic reasoning, but attempted to find the finest combination between utilitarianism and pragmatism in law to exert the social function of law maximally. Posner attaches great importance to the explanation of the philosophical foundations and analyzes concretely utilitarianism in his theory. His discussion of the relationship between efficiency and justice from the perspective of pragmatism offers detailed analysis of the utilitarian foundation of Economic Analysis of Law.
