摘要
清代官吏惩戒制度分为行政处分、刑罚制裁两大类别。其中定期行政惩戒,贪酷者革职提问,不谨、疲软皆革职,年老、有疾者休致,才力不及者降二级调用,浮躁者降三级调用。不定期行政处分分为罚俸、降级、革职等。刑罚制裁之正刑则有笞、杖、徒、流和死刑五种。无论行政处分还是刑罚制裁清代都有一定程度的落实,并取得了一定成效。没能达到澄清吏治并挽救清朝统治的最终目的,既有该制度的原因,也有影响制约该制度效果的其他原因。
In the Qing Dyamsty, the officials's penal system includes two parts: disciplinary sanction and penal punishment. According to the regular disciplinary sanction, the grafters will be dismissed and detained for inquiring, the imprudent and the incompetent will both be dismissed, the old and the diseased will retire ahead of time, the untalented will be demoted two ranks and transferred to another post and the impetuous will be demoted three ranks. The irregular disciplinary sanction covers forfeiting salary, demoting, dismissing and so on. The main penal punishment has five:kinds: whipping by small bamboo clappers, lashing by paddle, reforming by labour, banishing and executing. However, the penal system failed to achieve its effect as the result of its own institutional deficiencies and the factors that influence and restrict the effect of the system.
