摘要
离婚损害赔偿制度,是我国2001年修正后的新《婚姻法》增加的一个内容,它是婚姻法理论研究的重要课题之一。从离婚损害赔偿责任的构成要件,离婚损害赔偿的适用范围、请求权的行使以及确定赔偿数额的因素等方面,探讨我国的离婚损害赔偿制度,并对完善我国的离婚损害赔偿制度提出了建议。
System of compensation for divorce damage, a new content in latest＂ Marriage Law＂ amended in 2001, is one of the important topics of studying marriage law theory. This essay discusses and has made suggestion to the system of compensation for divorce damage from the following aspects ： component elements, the scope of application, the exercise of and the affirmation of the sum of money for compensation.
