摘要
动物福利保护标准用作贸易标准具有形式上的合法可能性,因而在国际贸易中得到广泛的应用。目前,世界上共有100多个国家建立了比较完善的动物福利法律体系,该类立法对于促进本国的动物国际贸易或者加强本国动物产业的保护具有积极的作用。由于动物福利立法不健全,作为世界上最大的动物生产大国,我国每年遭受的国际贸易损失始终位于全球第一。因此,我国借鉴国外的经验加强动物福利立法,是非常必要的。全面加强我国的动物福利保护立法,目前应遵循人与动物在法律地位上不能平等的原则和动物福利的分类处理的原则。
As it is possibly to be formal legitimacy, animal welfare standards have always been used widely as trade stand ards. At present, more than 100 countries have constituted perfect animal welfare legislative systems. This kind of legislation has positive functions on boosting their international animal trade or protecting their internal animal market. As the animal welfare legislations are not perfect, China , a country that produces the most animals in the world, has always been the most losing country in international trade every year. So it is necessary for China to reinforce its animal welfare legislations based on the experience of foreign countries. In the process of reinforcing China＇s animal welfare legislation roundly, we should obey two principles. The first principle is that legal status of mankind and animal are not equal, The second principle is that animal welfare should be disputed in the way of different kinds.
