摘要
现行制度框架下,由于缺乏村委会选举权利的救济制度,导致村民选举权无法得到及时有效的保障;此外,对行政侵权行为处罚不力,也成为当下乡镇机关频繁侵犯村民选举权的制度性因素。因此,健全村民选举权的宪法、诉讼和行政救济体系,成为控制村委会选举中行政侵权和规范村委会选举行为的有效途径。
Under the current regulations frame, because of the lack of relief system of the right in the election of the village committee, the villager＇s right to vote is thus unable to get the prompt and effective relief. Meanwhile, the failure of administrational punishments which make up the two main institutional factors, are undoubtedly the roots that the administrative organ frequently infringe villager＇s right to vote. For this reason, the integrity of the constitution, lawsuit and administration relief system, which perfects villager＇s right to vote, is sure to be the effective way to avoid the encroachment of villager＇s right and non - standardized behaviors in the village committee election.
