摘要
本文介绍了数据库开发利用中存在的权利冲突和利益平衡问题。与其他观点显著不同的是,本文提出了“数据库DOI保护法”。主张为促进数据库产业快速健康发展,应采用版权法和DOI保护法相结合、以其它方法为补充的方法对数据库进行完整的知识产权保护。
This paper discusses the conflict between database - owner＇s legal right and database - user＇s reasonable right, the balance between database -owners benefit and public benefit, then introduces a new intellectual protection method, DOI protection. The author insists on the method of combination of copyright protection and DO I protection, with the supplement of other methods, so as to promote the database industry quickly and healthily.
