摘要
网络时代政府监管与个人隐私保护的冲突问题比以往更加突出,我国有关法律法规涉及到网络空间个人隐私权的法律保护问题,但缺少操作细则,立法应当对政府的网络监管权作出制约。在网络上实现巨大公共利益的同时,实现对个人隐私的保护。
The conflict between the network supervision and administration by the government and the protection of the personal privacy is becoming increasingly serious. The provisions related to the protection of the network privacy can be found in the relevant laws of China. But these laws lack the operation detail. The legislation to restrict the government＇s right of the network supervision and administration must be introduced. Thus the personal privacy can be protected and the great common benefits can be achieved from the network.
