摘要
我国应建立与福利国家、积极国家以及给付行政模式相适应的行政给付行为理论。这就必须改变传统理论中将行政给付定位于行政救助和行政物质帮助的不正确做法,拓展行政给付行为范畴,增强政府的授益性。为此,应将行政给付行为界分为行政给付行为、行政给付相关行为和行政给付效果行为。
Theory on administration presentation action should be established to adapt to the welfare country, positive country and the mode of administration presentation. Traditional opinion of administration presentation should be corrected. Divided into administration presentation action, administration presentation related action and administration presentation effect action; administration presentation action will help to construct the mode of administration presentation action.
