摘要
我国城市土地市场当前存在土地产权界限模糊、土地市场机制不健全、政府职能发挥未到位和土地立法滞后诸问题。完善我国城市土地使用制度,应以土地权利为核心,以物权理论为基础创新土地产权制度;要打破政府对土地一级市场的垄断,实行土地出让金分期收取制度;以立法限定拍卖出让土地使用权的适用范围,建立划拨土地使用权入市许可制度。
There are some problems of ambiguous land property, imperfect system and administration of land property market and the delayed legislation on China' s urban land market. The author of this article believes that it must be on the basis of the right of estate and to analyze the land property and create a new land property system. The article also dwells on the deletion of the government monopolization on the main land market, the adoption of the methods to collect the land price by stages, legal limits of the activity of auction of the right of usage of land and the allowance for usage of land.
