摘要
公示公信原则为物权法的一项重要且基本的原则,依物权变动的便捷性要求,登记不是不动产物权变动的唯一公示方法,而其他公示方法与登记具有同样的公信力,但为了保证物权变动的安全,则应赋予登记以最强的公信力;善意取得制度是对公信原则的贯彻,其本质并不要求其只适用于动产交易,在不动产交易中也可适用善意取得制度以实现不动产交易的“动”的安全。
Repondering the public show and public faith principle affirms that registration is not the only public way of the real right alteration for the estate, conforming to convenience in the alteration, and the others also have the public faith. However, among them registration has the strongest public faith to promise the safety. The goodwill obtaining system obeys the public show and the public faith principle, and the estate bargaining, such as the chattel bargaining, may be applicable to the goodwill obtaining system to protect its moveable safe.
