摘要
法律社会学是产生于19世纪末20世纪初的一种西方法学理论,与传统的实证主义法学相比,法律社会学更加重视法在社会中的实际运行状态和效果。虽然欧美法律社会学有许多共同特点,但两者之间的差异也是不言而喻的。本文首先对欧美法律社会学的历史发展进行了简要的勾勒,进而从哲学基础、法律传统和研究方法等方面分析了欧美法律社会学的不同特点,以期加深对西方法律社会学的认识。
Sociology of law is a kind of law theory in the west that came into being at the end of 19 century and the beginning of 20 century. Compared with the traditional positivism of law, sociology of law pays more attention to the practical state and impact of law in society. Although there are some identical characteristics in the sociology of law in Europe and United States, they do have some differences. This article outlines the historical development of sociology of law in Europe and United States, and analyses the different characteristics in Europe and United States from the aspects of philosophy, law tradition and research approach in order to get a further understanding on sociology of law in the west.
