摘要
传闻规则是英美证据法的基石之一,它的产生、发展、演变的过程无不折射出英美普通法最本质的特色与发展趋向。“它山之石,可以攻玉”,对传闻规则的研究有助于我们在借鉴西方法律时,进行理性的思考与选择,而不能一味盲目地照搬西方的证据规则。
The rule against hearsay is the basis of evidence rule of the common law, whose evolution and development reflect the basic characteristic and the tendency of the common law, Accordingly, it will be of great help when we try to learn something from it. On the other hand, the study of the rule will be helpful for us to think more carefully and make decisions more cautiously during the learning process. Learning does not equal to imitation without thought but needs rational comparison and choice.
