摘要
网络犯罪是与网络产生和发展相伴而生的一种犯罪现象。它有刑法学意义上的犯罪类型和犯罪学意义上的犯罪类型之分。与传统类型的犯罪相比,网络犯罪具有超隐蔽性、高智能性、跨国性、侦查取证难度大、危害后果严重等特点。由于网络犯罪是由多重因素共同促成的,因此,对网络犯罪的防控也应从法律、道德、文化和技术等多个角度和层面入手解决,才会达到预期效果。
The network crime is a kind of crime phenomenon which comes on with the production and development of the network. According to the different angle, one is described Criminology and the other is illustrated Criminal Law. Compared with the traditional crime type, the network crime has some striking characteristics such as ultradisguise, high intelligence, internationalization, tough difficulty in collecting evidence and serious damage to the society. Because the network crime is caused together by the various factors, so prevent network crime should include such a lot of aspects, as law, morality, culture and technology, etc, which will make us reach the anticipated result.
