摘要
在医疗事故罪中,医师注意义务的认定直接关系到本罪的成立与否。医疗水准与医师所应负的注意义务息息相关。医疗水准应指实践上的医疗水准,其形成原因主要是由医疗知识和诊疗技术的局限性决定的,其形成方式应通过一定的程序。要正确处理医疗水准与医师注意义务的关系,要注意医疗水准在时间和地域上的差异性,正确认识专科医师与医疗水准、医疗习惯与医疗水准的关系。
In the Malpractice crime, the cognizance of doctor＇s attentive duties directly relates to the verification of the case. The medicial standard is in great relation with the doctor＇s attentive duties. Medical standard should refer to the medical level in practice the reason of whose formation is determined by the limitation of medical knowledge and diagnosis technology. Meanwhile,it should be established by a certain procedure. We should pay attention to the difference of the medicial standard with regard to the time and the region,and deal with the relationship of the medicial standard and the doctor＇s attentive duties correctly. It is also important to recognize the relationships between＇the training doctor and medical customs,between medical customs and medicial standard as well.
