摘要
关于单位犯罪,司法理论界和司法实践中有不同的理解和阐述,一直没有定论,造成了一定的混乱,应当通过立法予以完善。本文试图对单位犯罪的概念和特征进行诠释,明确如何对单位犯罪进行认定与处罚,分析单位犯罪立法的不足和对策。
There is no final conclusion concerning the unit crime because of different understanding and exposition in judicial theory and judicial practice. This causes the confusion and it should be improved by legislation. This paper explains the concept and feature of unit crime, defines the punishment of it, and analyzes the shortcomings of legislation and appropriate counter measure.
