摘要
富勒将他有关良好秩序的研究界定为“有关良好的秩序以及可运行的社会诸安排的科学、理论或研究”,并将其命名为eunomics。eunomics本身既有实质的问题指向———关注公平的、公正的和尊重人之尊严的秩序,同时又是作为一种法律研究的方法在起作用。富勒对这一研究方法的具体践行主要体现为对法律程序的研究。富勒对良好秩序的研究以手段与目的关系的讨论为前提,该研究本身可被看作是对现代性的反思,同时也体现了对现代二分思维方式的克服和超越。
Fuller defined his study of the good order as "the science, theory, or study of good order and workable social arrangements" and christened it "eunomics". Eunomics itself not only had the substantial designation of problemconcerns itself with the order that is just, fair, workable, effective, and respectful of human dignity, but also worked as an approach to legal study. This approach embodied the study of legal processes. Fuller's study of good order took his argumentation of the relation between means and end as the precondition, the study itself can be viewed as the reflection on modernity, at the same time, it reflected his overcome and surmount of the modem dimidiate thinking mode.
