摘要
目前造成国有森林资源资产运营效益低下的原因主要是“所有者缺位”“管理者越位”“经营者没到位”,也就是国有森林资源资产运营主体不明晰。在对国有森林资源运营主体及其内涵界定的基础之上,对国有森林资源资产运营竞争型和非竞争型主体进行了重新构建,并对二者的性质进行了阐述。同时按照国有森林资源资产所有权主体一元化、经营权主体的人格化、委托—代理关系的简捷化、国有森林资源资产所有权代理职能与社会经济管理职能分离、政企分离、资本经营与生产经营的分离、竞争性与非竞争性国有森林资源资产分别运营的原则对国有森林资源资产运营主体进行了具体定位。
At present, the reasons that cause the low benefit of the state- owned forest resources＇ property are mainly “the owner＇ vacancy”, “the excess of the administer＇ s authority” and “the operator＇ s vacancy”, that is, the uncertainty of the entity of the state-owned forest resources. On the basis of the defining of the entity of the state-owned forest resources and its connotation, this thesis reconstructs the competition and non-competition entity of the state-owned forest resources＇ property, and elaborates their features. Meanwhile, according to the principles of the integration of the ownership of the state-owned forest resources＇ property, the personification of the entity of the management authority, the simplification of the request-proxy relations, the separation of the function of the state-owned forest resources＇ property with the social economy management, the separation of the government and enterprises as well as the self-operating of the competitive and the non-competitive state-owned forest resources＇ property, this thesis specializes the entity of the state - owned forest resources＇ property.
