摘要
对于行政行为与民事行为共同侵权案件的审理,现行立法尚无明确规定,导致司法实践中的争议和盲点。行政行为与民事行为共同侵权案件的性质、特点和最高人民法院的司法解释决定了这类案件可以适用行政附带民事诉讼进行审理。案件审理过程中,法官应充分行使释明权,分两个层次三个部分进行全面审理,适用统一的过错责任原则以及准确划分侵权人的赔偿责任。
For administrative act and civil action common infringement case , the current law have no explicit provision still, causing the blind in judicial practice. The case＇s property, characteristics and the Supreme People＇s Courts＇ explain decide that it can apply administrative litigation with incidental civil action . The judge should use the clear power well, decide the inputation principle and designate accuratly damages.
