摘要
传统的司法管辖权的管辖区域是确定的,有明显的地理边界。而网络空间则是一个全球性系统,其不确定性使传统管辖基础陷入困境,面临着网络发展对国际民事管辖权的挑战,应分析借鉴国外关于网络管辖权的立法与实践,完善我国网络管辖权规则。
The scope of the traditional Jurisdiction was certain and had apparent geographic limitation. However, the space of network is a global system. Its uncertainty put the base of traditional jurisdiction into trouble. This thesis is about the challenge towards international civil Jurisdiction of network development, and put forward our imagination for perfecting our Jurisdiction of network.
