摘要
宪政建设的必要性要求我们对我国宪政建设的前提假设作一番检讨,研究宪政问题要以一种温和的、适度怀疑的、实用主义态度。我国百年宪政史的目的在于“富强”,从这种研究态度出发,那么我国目前宪政建设急需的就是宪法司法化。
The presume of Chinese constitutionalism is questioned in this article. A moderately suspect method on constitution research is presented. On this base, the authors argue that the objective of the century constitutionlism in China is “prosperous”. Finally, the authors, recommend that constitutional law applied in courts is urgent need of contemporary constitutionalism in China.
