摘要
近百年来的中国法治之路并没有从实践上说明，中国是否确实应当实行法治。在各种 反思中人们一般将目光锁定在中国传统文化的保守性上，却鲜有人明了中华民族文化传统之精 义，由此在民族救亡中的彷徨与羁绊、旧学与新知、革命与改良、制度与学术等交互在一起，构 成复杂的难题。但是，西学之法律技能以及其所属的知性文明与以中国为代表的心性文明所攀升 的哲学观念，从另一个侧面印证了百年危机的根源。
The author holds that China＇s effort to establish a legal nation in the past century has failed to bear out the necessity of such establishment in China. Enormous attention has been paid to the conservativeness of the traditional Chinese values and thus their essence is neglected. This is the reason why for so many years the Chinese people have been struggling in vain for a solution to many of their problems. The conflict between the legal ideal and the related rationalism from the West, and the virtual governance of the East is another reason for such crisis.
