摘要
劳动教养制度是具有中国特色的法制制度 ,但其在实体构成和适用程序方面都明显违背刑事法治和程序正义的基本精神 ,亟待改善。只有将劳动教养行政权转换为司法权 ,才能使劳动教养获得正当性。
The system of reeducation through labor is a legal system of Chinese characteristic. However, in the substantive formation and procedure of application. The system against the sprit of criminal administrated by law and procedure justice,it should be improved. If the system will to be legitimate,it must be transformed from executive power to judicial power.
