摘要
土地是农民最基本的劳动对象和经营基础,保障农民的土地财产权利是农民权益保障中非常重要的一个方面。由于现行的土地征用制度基本形成于计划经济时代,其赖以存在的制度环境和服务目标已经转变,不适应性和滞后性日益彰显,引发了大量的农民上访、对抗事件。鉴于土地征用制度在今后相当长一段时期都将是一个涉及面甚广的公共问题,本文在制度层面对现行土地征用体制存在的缺陷和不足进行分类和归纳,提出新的土地征用制度,以保证经济持续健康发展中,改革土地征用制度,保障农民土地权益。
Land is the basic labour object and management foundation for the farmers, and to ensure the land property rights is very important thing in the farmer＇s right protected. Because the existing land requisition was formed in the planned economy years, the system is unfit and old, and the environment and the goals are changed, so many farmers appeal to the higher authorities for help and confront for their rights. The thesis classifies and concludes the limitation and lack, and brings forward a new system to reform the existing land expropriation and to ensure the farmers land rights for developing the economy.
