摘要
关于古代中国是否存在国际法,中外学术界主要有三种观点,即古代中国不存在国际法;古代中国国际法仅存在于先秦时期尤其是春秋战国时代;古代中国国际法存在于中国古代各历史分立时期。概述这三种观点并结合相关理论和史实对它们进行评析,以求更好的弘扬中国传统法学文化。
There are main three views in the world academia about whether international law existed in ancient China： there was no international law in ancient China;only in pre - Qin period, especially during the Spring and Autumn period and the Warring States period, did it exist; international law permeated through all the independent periods in the ancient China. Summarizes the three views, analyses and makes the comments on them on the basis of relevant theories and historical facts,so as to carry forward the Chinese law traditions.
