摘要
近年来,在西方经济学界,经济学不断向其他社会科学学科渗透。70年代以来,法律经济学在西方取得迅速发展,经济学分析方法已经被应用于分析各个部门法以及重大的社会问题。法律经济学在个人主义方法论的立场上采用了经济学中一系列的基础理论和假设,通过成本收益、激励分析等方法的运用来解释法律,预测特定的法律的影响和以效率为核心价值来进行法律的规范研究,对于法律经济学方法论的认识可以深化对法律经济学的理解。
in recent years, in western economic circle, economics keeps penetrating into other social sciences subjects. Since 70s economic Jurisprudence has grown rapidly in the west, and economic analytical methods have been applied to analyze section laws and vital social problems. Economic jurisprudence takes a series of fundamental theory and hypothesis of economics explains law through adoption of cost and profit methods, stimulation analysis and so on, predicts certain laws effects and launches legal standard study with efficiency as the core value. The cognition of economic jurisprudence methodology can deepen understanding of economic jurisprudence.
