摘要
明确合理的风险分担是工程项目能否顺利实施的重要因素。对此工程活动的风险识别不能简单化,应该结合工作结构分解、组织结构分解和风险结构分解来定义。通过比较《国内施工合同示范文本》、《FIDIC施工合同条件》、《NEC工程施工合同》在风险分担上的相关条款,总结了三者在风险分担上的不同。
Construction activities are always uncertain and dynamic, and associated with risks that always result in complex disputes inconstruction projects, thus it is very unportant to allocate construction risks properly among the participants. This paper identifies typical construction risks by combining WBS, RBS and OBS together, and compares the terms on risk sharing anong the Internal Construction Contract and FIDEC and NEC.
