摘要
由于《反倾销协议》立法的模糊而直接衍生出来的替代国制度一直是理论界批评的重点。但是,尽管替代国制度存在种种缺陷,短期内完全废除该制度却是不可能的。《反倾销协议》应该吸收其他国家反倾销立法的经验并加以创造,以尽可能减少替代国制度的消极作用。
The substituting country＇s system derived out fuzzily and directly legislating because of “ anti-dumping agreement” has been the focal point that the theory circle has criticized all the time . However,although all sorts of defects exist in substituting country＇s system, it is impossible to totally abolish this system shortly. “ Anti-dumping agreement ” should absorb the experience that other countries’ anti - dumping legislate and create in order to reduce the negative consequence which substitutes country＇s system as much as possible.
