摘要
在高校权力“两分”的思维模式下,无法建构学术权力和行政权力的协调模式。必须突破这一思维模式,融合两种来源不同、相互冲突的权力,使之统一于法权威和法的精神之下。因此,必须正确定位两种权力及其作用领域;必须形成高校、教师和学生之间良好的法律关系;必须建立法权威基础上的科学决策体制;必须建立权力运行过程中的程序规范。
In the institutions of higher learning, we now can not construct, the harmonious model between the administrative power and the academic power which are usually different and conflictive, unless we change our thought of the dichotomy and unify the administrative power and academic power. In order to do that we must correctly orientate their domain, make a legal relation among the institutions of higher learning and teachers and students, build a scientific mechanism of decision-making on the basis of the authority of laws and set up the legal procedure of the administrative power and academic power.
