摘要
“母法”是理解中国宪法问题的一个关键性概念,其含义是宪法为普通立法提供依据。“母法”观念妨碍了宪法至上的实现,对我国目前的宪政与法治建设特别是宪法修改也存在消极影响。本文认为,应确立“普通法律不得与宪法相抵触”的原则,建立违宪审查制度,确保宪法至上。
“Parent Law”, as a key word to understand the constitutional issue of China, means that the constitution provides a foundation for legislation. The idea of “Parent Law” has negative influence on the construction of constitutionalism and rule of law. The author advocates the principle that common laws can＇t be in conflict with the constitution and judicial inspecting system should be established.
