摘要
劳动权是一项基本人权.劳动作为改造罪犯的手段,在我国监狱刑罚执行中长期坚持.多年来,法律对罪犯劳动的规定,从"强迫"到"必须",从"无偿"到"有偿",不仅表明刑罚执行中有关劳动改造实现方式的人道性趋势,而且表明劳动作为罪犯权利已得到确认和保障.对罪犯劳动权的正确确认,是依法保障罪犯劳动权的前提和基础.
The right of labor is a basic human right. As transforming the criminal＇s means, labor has been insisted on in our country＇s prison penalty. For many years, law defines criminal＇s labor, from “forcing” to “obligated”, from “free” to “paid”, which not merely indicates the humanity trend in penalty, but indicates that labor is confirmed and ensured as criminal＇s right. To correctly affirm the criminal＇s right of labor is the prerequisite and foundation of ensuring criminal＇s right of labor in accordance with the law.
